In the lecture, I will discuss the following emphasizes as regards content:
- Several position-fixings in the matter of industrial property rights (Where do I resp. my company stand in respect of industrial property rights?
- Identification of the legal positions of the competitors (copyrights, brand names/ corporate names/ domains, patents/ rights of utility models and ornamental designs of the competitors)
- Protection of trademark rights of one’s own (selection of the brand, research of older rights, application at the trademark office, enforcing a recoverable entry at the patent office)
- Creation of patent rights of one’s own (research of older rights, extensive application at the patent office, enforcing a recoverable entry at the patent office)
- Protection of designs of one’s own (accurate reproduction of the subject of design, research of older rights, extensive application at the patent office, enforcing a recoverable entry at the patent office)
All in all, the point of my lecture is to awaken the awareness, that a participant of the economic competition is situated in a legal environment, which has to be analysed in a first position-fixing and can be enhanced systematically and success-oriented in another step due to creation of trademark rights of one’s own.
